Federal law provides significant penalties for felons in possession of weapons, unless the felon has his rights restored by the convicting state.

Anyone who has been convicted of a felony is banned by federal law from ever possessing “any firearm or ammunition." Specifically a person "convicted in any court of a crime punishable by imprisonment for a term exceeding one year" cannot possess any firearm in any location. 18 U.S.C. 922(g) is the federal law that prohibits anyone ever convicted of any felony to ever possess any firearm either inside or outside of his home. The federal punishment for felon gun possession is up to 10 years in prison.

There are many other federal gun ownership restrictions. For example, a conviction for a misdemeanor domestic battery results in a loss of gun rights. A person who is the subject of an order of protection may not possess a weapon. In light of the 2008 case of District of Colombia v. Heller, such restrictions may now have Second Amendment implications. A good summary is available from the Bureau of Alcohol Tobacco, Firearms and Explosives.

The Statutory Exception

The rule prohibiting felon gun ownership has some exceptions. There is specific statutory language providing that the federal criminal firearms possession does not apply to individuals who have had their civil rights restored by the state in which they where convicted of the felony.

18 U.S.C. 921(a)(20) provides:

"Any conviction which has been expunged, or set aside or for which a person has been pardoned or has had civil rights restored shall not be considered a conviction for purposes of this chapter, unless such pardon, expungement, or restoration of civil rights expressly [or implicitly as a matter of state law] provides that the person may not ship, transport, possess, or receive firearms."

State Law Restoration of Rights

State law determines the restoration of civil rights for a state conviction, not federal law. The civil rights restoration must incorporate the right to serve on a jury, the right to seek and hold public office, and the right to vote. Absent restoration of these rights federal recognition of the state restoration of rights exception will not apply.

Federal law contains another passage to be considered. If the restoring state includes the three rights above, then one must determine if state law in any way restricts the convicted felon’s rights to possess a weapon. If there is any state restriction on the felon’s right to have a weapon then the possession of any firearms by the convicted felon is federally illegal. This is true even if all other civil rights are restored.

In the end, federal restrictions on the possession of firearms by convicted felons are entirely dependent upon the restrictions imposed by the various states. If there is a state restriction on an individual’s gun possession as the result of a criminal conviction, then possession is a violation of federal law.

The Process for Restoring Rights

Every state has its own process for felons to petition the government to restore their civil rights. Rights can be affected by the expunging or sealing of records which are judicial actions or pardons from the governor, which are executive actions. The level of restoration may be affected by the crime itself, whether it is a violent crime a drug crime or a crime of dishonesty. State laws vary greatly. i have been looking for this information for so long and it was in the easiest place to find it. I personally asked a lawyer in California how should i go about restoring my constitutional rights and he was of absolutely no use. I am sure that gun-rights are not important to some lawyers or people personally but i believe that everyone should be concerned about the rights guarranteed in our constitution. If i adhere to the Law then i should have every privlege. Thank you

I have a felony conviction in federal court, and I am planning to sue for my rights to be restored after my period of supervision. I am aware that BATFE does not process the applications due to funding, but the law does allow one to petition the local district court if the petition is denied. I plan to claim a violation of my rights to due process, since I am not being allowed to take advantage of a remedy which still exists in the law. One main point will be that BATFE can always charge an application fee, as INS does for visa applications, thereby nullifying the congressional funding issue all together. I have not seen this arguement tried in any case.

i have a felony conviction. non violent!! i have paid my dues to society, who among you hasn't made a mistake in your life. am i not still a american?? i say yes i am!! im expected to live by our great countries laws, pay taxes but yet im no longer protected by our own constitution. so i ask where is the justice?? i am a good god fearing loyal red blooded american who would lay his life down for this great country any day of the week. so i live by and respect the laws of our great country should i not be treated as a equal. thank you and god bless

I live in Alaska and need to hunt to provide for my family. My conviction was for assault, but it was a fistfight and I have never used a gun irresponsibly. I think the laws should be changed to reflect that.

Fellow Americans, I feel all of your pain. I too have a past federal felony conviction (1998 level 3 Trademark Infringement). I've been working on this one for awhile now. It's ridiculous and pathetic to know that as things stand for now, all of us will NEVER be done paying "our debt back to society." I have lived like a monk for 10yrs, and that, nor any amount of time will restore the rights that I'm entitled to... never!
Hypothetically, if more years pass by, and my wife and kids are sleeping in our home, that is broken into by armed crackheads with Uzi's. What I'm I going to do?? Shoot them with my kids slingshot?!? I don't think so. There's is saying that applies here. It says... It's better to be tried by a jury of twelve, than it is to be carried by six. Good Luck my brothers.

Our constitution guarantees us the right to protect ourselves, and the bureaucrats have taken away many of our naturally given liberties, just for things like to impress their image in front of the elderly, and rich with body guards. We as people should not fear the government, the government should fear us, we can fire the entire Congress, non violently, peacefully, historically, we can only accomplish it if enough of us unite to bring back what's ours, to take away the injustices and current paradigms set by those who created laws strictly for self-gain. The worst thing in the world is to be a helpless sheep, to have a feeling of legal right to do something, and have it being denied legally, because of things we can never understand, or don't want to. Until we unite to bring back justice, we will go on our usual routines as blind sheep, and everyday more and more things will be taken away from us. We really forgot the true meaning of "Of the people, By the people", we as taxpayers can fire the government only if we unite as a cause, and not unite as in communism, but unite as a Democratic cause, by Democracy, for the Democracy. What really is not Democratic, is the fascism that goes on in this country, separating classes by blood, if we don't unite peacefully, this country might be headed for a revolution... We as a country are a young nation, and we must learn from history to prevent the mistakes of mankind.

I have been charged with felony weapons possestion after i got caught with a BB gun in Nj.. shooting at a target away from ppl In a safe location . I cant believe that the state of NJ gave me 5 yrs probation and a felony charge for a toy I bought in another state on vacation for 25 dollars. It cost me thousands in court costs and they wanted to give me 270 days in prison. I would like to join the military but can not due to my dumb ass conviction in a dumb ass state. It makes no sense that i would be stuck with a felony on my record and have to explain owning a BB gun.. wtf.?
I am going to try and restore my rights next year when my probation is over. which they are making me do the full 5 yr term and i havent violated once. I have never been in trouble nor am I a bad ass or a trouble maker. makes no sense

i am a convicted felon from 12 years ago. drug charges. nothing of a violent nature. i have paid my debt and i have had my rights restored. after months of research,on my own and with attorneys, i was told that i could own firearms. i accuired quite a few over the past five years. 14 to be exact. last year they were taken from me and i was facing 44 months for felony possesion of firearms. i was told that i used to be able to own them but the law had changed. i was arrested and taken from my home infront of my 6 year old as the police loaded up thier cars (that i pay for) with my guns and ammo. i had some nice stuff and i could hear them talking and saying things to each other like "check this one out". after i bailed myself out jail ($7500) i recieved a phone call a few days later. i was told that if i signed a piece of paper saying that i turned in my guns so the police could use them for "training purposes" then the charges would be dropped. i was advised, by my attorney, to do so while the cops divided up MY GUNS amongst themselves. my hands were tied. if you look around you wil see that all of our hands are becoming tied. not just because of gun laws. i am talking about EVERY aspect of our country and its government. this place has turned into exactly what our forefathers intended it NOT to be. someone on this page made a comment about the possibility of a peaceful revolution. i think a revolution is long overdue! i also think it can be very peaceful and simple. nobody needs to be physicaly hurt. we pay them. that makes them our employees. fire them! all of them! how? stop paying our taxes. stop giving them our money! our money is their bloodflow. cut it off! lets find some people who truly care about this country. people who will represent us and respect us and be honest and fair with us. i would love to be one of those elected people but i can't! i'm a convicted felon...remember?

This topic is so touchy. I've been convicted of a class e felony non violent non drug related or anything like that... in the state of Ohio. I read along the lines of this that says all rights must be restored to restore your right bare arms. I'm so unsure as to if I could federally ever be allowed to own a firearm but according to my understanding of http://www.sentencingproject.org/doc/File/Collateral%20Consequences/Ohio.pd f I can once it's expunged in the state of Ohio. I'm so confused on this and I'd hate to run into the same situation as the post above.

I think it's particulularly pertininent to my situation. Back in '07, I was arrested for DUI, while legally carrying a .44 mag under concealed permit (this is in
Arlington, VA), and the weapon was confiscated and put into police property. Fast-forward a few months, and my wife takes out a protective order against me (for dubious claims of domestic abuse - non provable -_which means that I cannot get back that weapon from the police dept. until the year-long protective order expires.

Now, flash-forward, I've just gotten out of jail after doing 16 months for prescription fruad. So, now, the dilemma is who do the police release this wonderful, old, historical weapon to? It's one of the first production Ruger "BlackHawk" .44 Mag. revolvers (4-digit serial #)/

Currently, my attorney is working on drawing up a "deed of gift" to transfer the gun to my mother, whose record is totally clean. Hopefully, it'll work!

I live in California. I never committed a crime using a firearm or any other weapon. However, I was convicted of a felony. I do own a firearm for protection. As far as I'm concerned, my families safety is far more important than my past mistakes.

Well 53 years ago i got a felony i did not kill know one and did not have a gun at that time. now i am 75 years old now. the law let me no i have NO rights and wont .just thank 53 years alot of time has went by 7/9/2010

Finally got my right to possess firearms restored in WA. It took many years of waiting patiently and a fantastic lawyer who kept his eye on the ball to make it happen. Problem was the State had passed a law at some point that changed my felony from a B to and A, even though it was a B when committed. Class A felons only hope in WA is a pardon from the governor, guess what, she's a former prosecutor, lol. Recently the State Supreme Court reversed that law basically saying if it was a class B then, it's a class B now. My lawyer jumped on it, filed the paperwork in Superior court and 4 weeks later I got my right to possess restored. An attorney skilled in this field is crucial unless you have a real cut and dry case.

Expos facto laws are not legal. For instance, you commit a crime that is a misdemeanor. Two years later a law is passed stating that the crime is now a felony, it does not make you a felon. It is only a felony to people who commit the crime after the law.

I was convicted in 1969 of allegedly breaking into a gas station, and stealing something to eat. Was told by a deputy sheriff, while he had a .357 stuck in my ear, that I would plead guilty, or I would not live to see daylight again. I had just witnessed him cold blooded murder three people while waiting to go to court, so I had no reason to believe he would not kill me. It is near impossible to get a pardon in the state where I was convicted, or even the restoration of rights if it happened before around 1981. Three years in prison, and 40 years of no convictions afterward, and I'm still paying for being in the wrong place at the wrong time.

I can't honestly believe that this is what our forefathers ever had in mind.

Our rights as americans promised by the original constitution have been dragged through the mud to the point where it is unreconizable. Our so called government has no problem putting a gun in the hands of a felon to go and fight on the behalf of america but when it comes to protecting and providing for ones family they have successfully made it impossible, unless your willing to take the chance and hope that the firearm passed on by family that is no longer with us is never needed to be used. Just like katrina the government didnt show up until most of the horrible, unthinkable crimes were already comitted, dont find yourself in that kind of situation unprepared! Without us the people there is no need for our so called government and unless they realize this I hope that the average no longer middle class american and any one else who has been treated by our government will stand as one and say enough is enough. Egypt is doing just this and Americans need to get their heads out of there ass and realize that when the unthinkable happens the only thing they can count on is themselves. If you honestly beleive the government is going to send your family transportation to a safe haven u are incredibly nieve or your part of the problem! May God bless true americans and the hardworking, decent humans all around the world. For the rest of you may God show mercy when you did not!

In Heller 2nd amendment is protected by the 14th privelege and immunity clause, so is the state courts legally able to sentence you to more than one year? ask your self that and remember "shall not be infringed"

Most americans have no rights anymore,the powers that be have raped the constitution to no end and distorted it to fit thier own agendas,if youre with us you can have all the guns you want some even paid for by the government,if you dont wear thier shiny badges and do thier bidding,then you are against them,and they will do anything and everything to take whats yours.nice....im going through all this now because my g/f was a gun owner,and left them in my house when she moved out,i am now facing felon in possession of a firearm charges,even though she had them locked in a safe until she could get them to her new house...

I feel the pain of many of you folks. America today is not what the founders or Patriots who fought for or invisioned. It's sad and unfortunate that some worthless scumbags have destroyed this once great nation. It doesn't take much to catch a case these days. The gentleman with the BB gun story makes me sick to my stomach thinking about the wasted talent that young man could have become, because of ridicoulus laws. People with much talent are prevented from becoming something great because of a law enacted by some fatcat politician who gets kickbacks and rapes America. I'd love to punch them in the nose. Folks the only way to change things is time. As more and more of these old farts leave this planet more and more open minded people will be in a position to vote these clowns out for good. it is crazy my father was convicted of his one and only felony in 95 ( drug charge ) and after serving 19 months ( model inmate) and 3 years fed probation ( no violations) he continued to raise me and my brother alone and maintain a respected name in our community . He has had nothing but 1 traffic violation in 16 years , but was an avid deer hunter , and when asked admitted to it , plead guilty and recieved 2 years last thursday after hes being on house arrest for 6 months ( which will not be counted as time served ) Ifor 1 count of felon in posession ,(even though they had no evidence besides his statements and the possibility of making it mandatory for others to testify ) have found numerous cases of some really horrible individuals who are habitual offenders who have recieved probation for the same charge and more counts .. Then again i live in mobile, al and unfortunately there are a few of our beloved politicians , judges , and law enforcement leaders trying to advocate this new thug text program where you text in if you suspect a felon may have a gun , and recieve 500.00 if they get arrested and charged ! any advice is greatly appreciated , we have 1 week left to appeal , and we are hoping to have strong ground for it !

i have a felony conviction also I didn't do anytime. I like to get long gun / shotgun. I called the sheriff office to ask if I could get shotgun. They told me yes I could but no handgun. So I went to get shotgun they FBI check they came back and said it was on hold. I live in Indiana. I been seeing boars , mountain lions , bobcats, etc. just wanting one just in case if one of them come after me or people live around me.

Folks do what you gotta do. By all means better yourself and attempt to restore your rights. You don't need a lawyer and you have rights guranteed by the Second Amendment of the United States Constitution. Our ancesters gave blood, sweat, and death for us to be free today. Believe me our ancesters would be very angry with how people have been deprived of liberties and the injustices imposed on there great grand sons and daughters. Arm yourself and by all means defend your family from invaders. Hunt for food when needed to feed your hungry family. You must be prepared to defend and protect against the fascist way this country is turning into. STAND UP AND FIGHT FOR YOUR RIGHTS! Stay safe folks and God bless you all!
